TEK Hydration — Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of www.tekhydration.com (the “Website”) and your purchase of products from us.

The Website is operated by Park Place Wholesale and Retail Trading Company W.L.L. (شركة بارك بليس لتجارة الجملة والتجزئة), trading as TEK Hydration, a limited liability company registered in the State of Kuwait under Commercial Registration No. 547410 and Commercial Licence No. 2026/8745, with its registered address at Office 7, Floor 5, Ali Abdulwahab Al Mutawa Commercial Company Building, Abdulmunim Al Mubarak Street, Block 9, Plot 33, Qibla, Capital Governorate, Kuwait (“TEK,” “we,” “us,” or “our”).

By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

1. Eligibility

You must have the legal capacity to enter into a binding agreement under the laws of Kuwait. If you are under the applicable legal age, a parent or legal guardian must place the order on your behalf.

You are responsible for ensuring that the information you provide is accurate, complete, and current.

2. Products and Website Information

We take reasonable care to describe and display our products accurately. Product packaging, colours, appearance, and presentation may vary slightly from images shown on the Website.

Ingredients, allergen information, nutritional values, directions for use, warnings, and storage instructions appear on the product packaging and/or product page. You must read and follow that information before use.

All products are subject to availability. We may change, discontinue, or limit the quantity of any product at any time.

3. Health Disclaimer

TEK products are food or dietary products and are not medicines. Statements on the Website have not been provided as medical advice and are not intended to diagnose, treat, cure, or prevent any disease.

Consult a qualified healthcare professional before using a product if you have a medical condition, are pregnant or breastfeeding, take medication, follow a medically restricted diet, or have concerns about sodium, potassium, magnesium, or any other ingredient.

Use each product only as directed. Individual needs and results vary. In an emergency or if you experience an adverse reaction, stop use and seek appropriate medical assistance.

4. Orders and Contract Formation

Submitting an order is an offer to purchase. After you place an order, we may send an acknowledgement confirming that we received it. This acknowledgement does not necessarily mean that we have accepted the order.

A binding sale is formed when we confirm acceptance or dispatch the order, whichever occurs first. We may refuse or cancel an order before acceptance for reasons including:

• product unavailability;

• an incorrect price or product description;

• suspected fraud, misuse, or unauthorised payment;

• breach of these Terms; or

• delivery restrictions or circumstances outside our reasonable control.

If we cancel an order after taking payment, we will refund the amount charged for the cancelled item or order using the original payment method, subject to payment-provider processing times.

5. Prices and Payment

Prices are shown in Kuwaiti Dinars (KWD) unless stated otherwise. The total price, including any applicable delivery charge, will be displayed before you confirm payment.

You authorise us and our payment providers to charge the payment method selected at checkout. We do not guarantee that every payment method will always be available.

Obvious pricing, typographical, or system errors are not binding. If an error affects your order, we will contact you to confirm the corrected price or cancel and refund the affected order.

6. Discount Codes and Promotions

Discount codes and promotions are subject to their stated conditions and validity period. Unless expressly stated otherwise, they:

• cannot be exchanged for cash;

• cannot be combined with another offer;

• apply only once per customer or order; and

• may exclude certain products, bundles, subscriptions, or delivery charges.

We may reject or cancel the use of a code obtained or used through fraud, technical manipulation, resale, or breach of its conditions. Nothing in this section limits mandatory consumer rights.

7. Delivery

We deliver throughout the State of Kuwait. Delivery charges vary according to the delivery area and will be displayed at checkout before you confirm payment.

Delivery times are estimates unless we expressly confirm a guaranteed time. Delays may occur due to high demand, weather, public restrictions, courier delays, incorrect address details, or other circumstances outside our reasonable control.

You must provide a complete address and a reachable Kuwait telephone number. If delivery cannot be completed because the information supplied is incorrect, no authorised recipient is available, or the order is refused, we may charge a reasonable redelivery cost where permitted by law.

Please inspect your order promptly after delivery and contact us if any item is missing, incorrect, damaged, tampered with, or defective.

8. Cancellations, Returns, Exchanges, and Refunds

Your rights under Kuwait’s mandatory consumer-protection laws remain fully protected.

Subject to applicable law, a request to return or exchange a product should be made within 14 days from the purchase date shown on the invoice, and the product must remain in its original condition.

Because our products are consumable goods, we cannot ordinarily accept a product that has been opened, used, or had its seal broken where accepting it would create a health, hygiene, or safety concern, except where the product is defective, damaged, incorrectly supplied, or applicable law requires otherwise.

To request a cancellation, return, exchange, or refund, contact us at info@tekhydration.com and provide your order number, the reason for the request, and photographs where the item is damaged or incorrect.

Approved refunds will be issued through the original payment method unless another method is required or agreed. Original delivery charges and return-delivery costs will be handled in accordance with applicable law and the reason for the return. This section does not exclude or reduce any right or remedy that cannot legally be excluded.

9. Risk and Ownership

Risk in the products passes to you upon delivery to you or to a person you authorised to receive the order. Ownership passes when we receive full payment and the products are delivered, subject to applicable law.

10. Accounts and Website Security

If you create an account, you are responsible for keeping your login information confidential and for activity conducted through your account. Notify us promptly if you suspect unauthorised access.

You must not misuse the Website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape it improperly, or use it for unlawful or fraudulent purposes.

11. Intellectual Property

The Website and its contents—including the TEK name, logos, product designs, photographs, text, graphics, and software—are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may use the Website for personal, non-commercial shopping purposes only. You may not reproduce, modify, distribute, sell, or commercially exploit Website content without our prior written permission.

12. Third-Party Services and Links

The Website may use or link to third-party services, including payment processors, delivery providers, social-media platforms, and external websites. Their separate terms and privacy practices may apply. We are not responsible for third-party content or services outside our reasonable control, subject always to applicable law.

13. Privacy

We process personal information as described in our Privacy Policy, available at www.tekhydration.com/policies/privacy-policy. The Privacy Policy should be read together with these Terms.

14. Liability

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited under Kuwait law.

To the maximum extent permitted by law, we are not responsible for indirect or consequential loss, loss caused by misuse or failure to follow product instructions, or loss caused by events outside our reasonable control.

The Website is provided on an “as available” basis. We do not guarantee that it will always be uninterrupted, secure, or error-free, but we will use reasonable care in operating it.

15. Changes to These Terms

We may update these Terms to reflect changes in law, our products, or our business operations. The updated version will be posted on the Website with a revised effective date. The Terms in force when you place an order will normally govern that order, unless a change is required by law.

16. Severability and No Waiver

If any part of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply. A failure or delay by us in enforcing a right does not waive that right.

17. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the laws of the State of Kuwait. The courts of Kuwait shall have jurisdiction, subject to any mandatory consumer right to bring a claim before another competent authority or forum.
